Kirsteen Durrant

Partner at Ashtons Legal

She acts for commercial and private clients to resolve difficulties in connection with their property assets.

Kirsteen specialises in resolving property disputes and advises private, commercial and public sector clients.

She deals with commercial property matters, such as the termination and renewal of leases under the Landlord and Tenant Act 1954, break options, the enforcement of leasehold covenants, recovery of rent arrears and dilapidation claims. She also advises on residential matters such as termination and breach of assured or assured shorthold tenancies, enfranchisement and the right of first refusal. Kirsteen has particular expertise in matters that arise in both commercial and residential situations, such nuisance claims, restrictive covenants, adverse possession, rights of way and issues which fetter development schemes.

Kirsteen advocates for clients in Court, represents them mediation and delivers training. She has written articles on Air B&B, Tenant Deposit Schemes and unilateral variation of tenancy agreements for publication and has been quoted in the Guardian. She recently acted for a defendant in successfully dismissing a claim for possession at first instance and on appeal (Clarion Housing Association v Louise Carter [2021] EWHC 2890 (QB)).

Kirsteen is a trained mediator and a member of the Property Litigation Association.

She believes it is a privilege to help people through difficult situations and to lighten some of the burden – whether it be to achieve a commercial objective or to resolve an emotive residential dispute.

Kirsteen spends her spare time with her husband, their three young boys and their dog and, occasionally, she fits in some art or embroidery.
