Jason S. Kray is a partner with McDonnell Boehnen Hulbert & Berghoff LLP and serves as Chair of the firm’s Medical Device & Diagnostics Practice Group. Mr. Kray handles patent law matters in various technology areas, including electrical, mechanical, electromechanical, biomechanical, software and computer technologies. His clients range from large multinational corporations to individual inventors.
Mr. Kray focuses on helping clients build, manage and protect their intellectual property portfolios. By working closely with his clients to understand their business objectives, he helps them maximize the value and commercial relevance of their IP portfolios.
Mr. Kray has in-depth experience in patent prosecution matters, including drafting and prosecuting domestic, foreign and international patent applications; conducting personal interviews with examiners at the United States Patent and Trademark Office; drafting and filing appeal briefs; conducting oral arguments before the Patent Trial and Appeal Board; and drafting and prosecuting reissue applications. He works with clients to develop customized prosecution strategies that are guided by a strong understanding of his client’s commercial activities, the industries in which his clients do business and the companies against whom his clients compete.
Additionally, Mr. Kray has been involved in numerous litigation matters. His litigation experience includes drafting complaints, motions, memoranda and jury instructions; conducting discovery; and arguing motions. His litigation experience dovetails with his prosecution experience, facilitating his ability to procure appropriately broad, defensible patents on the one hand and comprehensively evaluate patents asserted in litigation on the other hand.
Mr. Kray’s counseling further involves patentability, freedom to operate, validity and other intellectual property landscape analyses to provide clients with meaningful advice and data that can guide their business decisions.
