Lindsey R. Trowell represents insurance and financial services companies in complex litigation. He has tried numerous cases, both jury and bench trials and has litigated complex class actions across the country.
Lindsey helps his clients litigate statutory issues, attacks on their business practices and contractual language with their respective customers. His clients often utilize his skills to litigate and manage volume litigation related to claims handling practices, with a focus on detecting fraud and developing fraud prevention. This role also allows Lindsey and his clients to manage the litigation and potential issues tied to ongoing or potential class action and anti-trust issues. The issues range from windshield litigation, diminished value, total loss valuations, PIP litigation and uninsured motorist litigation.
Lindsey approach has uncovered fraudulent activity by providers that seek payment under his clients’ customers’ insurance policies, which resulted in the prosecution of affirmative cases against providers to recover ill-gotten claim payments and curtail future similar fraudulent schemes.
Lindsey also has experience defending against alleged violations of the Telephone Consumer Protection Act and the Florida Consumer Protection Collection Practices Act. His experience includes proposed class actions and individual actions.
He also handles appeals arising out of the litigation he is involved in, as well as appeals arising out of matters that were handled by other attorneys. He typically handles the briefing, as well as oral arguments.
Lindsey has been recognized by Florida Super Lawyers Magazine as a “Florida Rising Star” from 2009 to 2017. He was also named an “Up & Comer” by Florida Trend Magazine in 2007 and 2012.
